行政垄断视角下公平竞争审查的实施困局及其完善路径

摘　　要：政府规制市场的方式缺乏公平竞争因素,使得政策措施大多表现为行政性垄断行为。《公平竞争审查制度实施细则》的颁布,将促进我国市场竞争环境的改善,消除商品、要素在自由流通中的各种壁垒。尽管公平竞争审查与反垄断法都能够助力经济发展,但两者并不相同。公平竞争审查在依据反垄断法保障经济效率的同时,还要兼具调整反垄断法无法规制的其他问题。基于此,公平竞争审查应当以反垄断法为基础,但又不能局限于反垄断法的框架,要以发展经济为核心目标,赋予政府适度的经济自主权。公平竞争审查制度的构建应当采取以当地发展水平为依据的分级实施模式,官员的晋升考核也要采用多元化标准,并以重点行业为中心逐步深化公平竞争审查。为保障市场竞争的实质公平,还需要考虑增加特定政府补贴类型的免责机制。The government's approach to market regulation inherently lacks the element of fair competition,making policy measures mostly manifest as administrative monopolistic practices.The in-troduction of the Rules for the Implementation of the Fair Competition Review System can help to op-timise the competitive market environment and break down barriers to the free flow of goods and fac-tors.Although both fair competition review and anti-monopoly law can contribute to economic develop-ment,they are not the same.While ensuring economic efficiency in accordance with the anti-monopoly law,the fair competition review must also regulate other issues that are not regulated by the anti-mo-nopoly law.For this reason,fair competition review should be implemented on the basis of the anti-mo-nopoly law,but not limited to the framework of the anti-monopoly law,with the core objective of eco-nomic development and giving the government a moderate degree of economic autonomy.The future construction of the fair competition review system should adopt a graded implementation model accord-ing to the level of local development,officials should be assessed for promotion using diversified crite-ria,and the fair competition review should be deepened gradually with a focus on key industries.In or-der to guarantee substantial fairness in market competition,it is also necessary to consider adding ex-emption mechanisms for specific types of government subsidies.
