摘　　要：搜索结果中的标红提示,既是搜索服务业态的通用功能,也是搜索服务提供者经营自主权的行使范围。当标红提示功能涉及人工干预算法策略,则可能导致其他网络服务提供者及网络用户的相关权益受损。本案从国内首例涉人工干预策略侵权的不正当竞争案例切入,通过剖析人工干预策略的底层逻辑,探究搜索网络服务提供者的经营自主权与被搜索网站经营者及网络用户的异议权、更正权及不正当竞争保护维权权利等权利行使的界限,展开对“算法黑箱”鉴定的技术逻辑的讨论,明确算法鉴定的必要性与可行性,以求在司法裁判中取得经营自主与权利保护之间的价值与利益平衡。The red highlighted prompt function in search results is not only a general function of search service formats,but also the exercise scope of search service provider's operational autonomy.When the highlighted prompt function involves manual intervention in algorithm strategies,it may cause damage to the relevant rights and interests of other network service providers and network users.This case starts from the first domestic case of unfair competition involving human intervention strategy infringement.By analyzing the underlying logic of human intervention strategy,it explores the boundaries between the operational autonomy of search network service providers and the exercise of rights such as objection,correction,and unfair competition protection rights of searched website operators and network users.It discusses the technical logic of"algorithmic black box"identification,clarifies the necessity and feasibility of algorithmic identification,and aims to achieve a balance of value and interests between operational autonomy and rights protection in judicial judgment.
