打击网络犯罪的实证研究——以5G技术背景下的刑法规制为切入点

摘　　要：在5G时代,优质的移动通信网络已进入社会管理、商业经营、工业生产等日常生活的数个领域。5G技术提供机会的时候也增加了一些挑战。刑法怎样规制5G技术背景下的网络犯罪已经成为管理社会当中不容忽略的关键议题之一。现行刑法在规制网络犯罪中存在着法益保护范围有待扩展、罪名体系设置有待完善、刑罚配置有待优化等方面的问题。为此,应采取单一立法模式与双重立法模式并存、增设破坏互联网基础设施罪、完善刑罚配置等措施,强化刑法规制功能,以应对并处置新时代网络犯罪带来的风险,更加有效地打击网络犯罪。In the era of 5G,high-quality mobile communication networks have penetrated various aspects of daily life,including social management,commercial operations,and industrial production.While 5G technology presents opportunities,it also poses challenges.How criminal law regulates cybercrime in the context of 5G technology has become a critical issue that cannot be ignored in societal governance.Current criminal laws have deficiencies in terms of expanding the scope of legal interests protection,improving the system of criminal offenses,and optimizing penalty allocation regarding cybercrime regulation.Therefore,it is proposed to adopt a dual legislative model,introduce offenses targeting the destruction of internet infrastructure,and refine penalty allocation to more effectively combat cybercrime.
