摘　　要：体育法学的理论研究和实践经历了“体育与法”和“体育法”的争论,逐步对体育法的独特性形成共识。不管是以体育仲裁、兴奋剂治理、自甘风险等为代表的“体育法”的独有内容,还是集体代言、注册交流等具有体育特色的“体育与法”的交叉内容,都共同为体育法学发展为独立学科打下了基础。随着以《中华人民共和国体育法》(以下简称《体育法》)为主干的中国特色体育法律规范体系的不断完善,在体育法学研究与实践需求的相互作用下,一种特殊的法律关系——“体育法律关系”逐渐显现、形成。它以体育行为为核心,明确并连接各主体之间的权利义务,有效划定了体育法的调整范围,为体育法独立部门法的确立提供了法理依据,夯实了体育法治的基石。The theoretical research and practical experience of sports jurisprudence have undergone debates between“sports and law”and“sports law”,gradually forming a consensus on the uniqueness of sports law.Whether it is the unique content of“sports law”including sports arbitration,doping governance,assumption of risk,or the intersection of sports specific features such as collective representation and registration exchange in“sports and law”,collectively laid the foundation for the development of sports law as an independent discipline.With the continuous improvement of the Chinese characteristic legal system of sports law,centered on the Law of the People’s Republic of China on Physical Culture and Sports,a special legal relationship—“sports legal relationship”is gradually emerging and forming under the interaction of sports law research and practical demand.It revolves around sports behavior,clearly defining and connecting the rights and obligations among various entities,effectively delineating the scope of sports law regulation,providing a legal basis for the establishment of independent departmental laws for sports,and solidifying the cornerstone of sports law governance.
