摘  要:《预防未成年人犯罪法》对未成年人严重不良行为进行了重新界定,并完善了针对严重不良行为的三种保护处分措施。由于未成年人严重不良行为与《治安管理处罚法》违反治安管理行为的适用范围存在交叉,在制度层面出现了保护处分措施与治安管理处罚的二元处置格局。实践中,公安机关对于未成年人严重不良行为仍以治安管理处罚为主,未能实现保护处分措施提前预防与治安管理处罚惩治之间的平衡。基于两种措施理论定位的不同,实践中应坚持“教育挽救”总方针,以“教而不罚为主,罚教结合为辅”为原则,充分考虑未成年人的年龄、行为危害程度等因素,分级分情况分类施策,妥当适用保护处分措施和治安管理处罚。The Law on the Prevention of Juvenile Delinquency has redefined juveniles'serious misconduct and improved three protective and disciplinary measures for serious misconducts.Because of the overlap between juveniles'serious misconduct and the scope of the application of the Public Order Management and Punishment Law for their violation,a dual handling pattern of protective punishment measures and public order management penalties has emerged at the institutional level.What's more,in practice,police agencies mainly use public order management penalties for their serious misconducts,failing to keep a balance between early prevention,protection and public order management penalties.Based on the different theoretical perspectives of the two measures,we should adhere to the general policy of"education and rescue"in practice,follow the principle of"education without punishment as the main approach or combine punishment with education as a supplement".We should take such factors into consideration as their age and degree of harm,take measures according to different degrees and situations,and appropriately use protective and disciplinary measures and public order management penalties.
