摘  要:案例教学是法学实践教学的重要组成部分,对提升学生的法律实务能力和综合实践能力具有独特作用。案例教学法的核心是由学生主导案例的分析、辩论和决策,从而获得能力的提升。但在我国法学课堂上,案例教学局限于案例举例或简单的案例讲解,这种“伪案例教学”无法真正发挥实践教学的效用,其根源在于教学理念的差池和教学方式的单一、僵化。我们要避开案例教学的误区,丰富案例教学的形式,坚持实践型案例教学法和个案全过程教学法,开展多元化的课堂案例展示活动,把课堂主导权交给学生。Case teaching is an important part of the practical teaching of law,which plays a unique role in improving students’legal practice ability and comprehensive practice ability.The core of the case teaching method is student-led case analysis,debate,and decision-making,leading to competence improvement.But in China’s law class,case teaching has degenerated into case examples or simple case explanation.This“false case teaching”can not really play the role of practical teaching,whose root lies in the difference of teaching ideas,and the single and rigid teaching methods.We must avoid the misunderstandings in case teaching,enrich the form of case teaching,adhere to the practice-based case teaching method and whole-process case teaching,carry out a variety of classroom case presentation activities,and let students dominate the class.
