我国民生物资价格干预法律制度的重构

摘　　要：我国民生物资价格法律制度规定的干预措施主要有价格直接干预措施、价格间接监管措施、价格整体调控措施。我国的民生物资价格干预措施存在的缺陷:价格直接干预措施对于稳定民生物价的功能有限、手段迟滞;价格间接监管措施在实践中存在权力扩张干预的倾向,其合法性边界较为模糊;价格整体调控措施存在以“管”代“调”的倾向,具有导致“政府失灵”的潜在风险。未来应当从以下几方面进行法治重构:通过健全程序控制,强化价格干预措施的制衡程序;明晰价格干预边界,对价格监管措施的要件与边界的合法性进行审视;重视市场供需关系,对《中华人民共和国价格法》集中定价的范围和使用进行限制,完善相关法律对于市场化调节的规定。The intervention measures stipulated in China's legal system for the price of livelihood commodities consist of direct price intervention measures,indirect price supervision measures,and overall price control measures.However,there are deficiencies in China's intervention measures for the price of livelihood commodities:direct price intervention measures have limited effectiveness in stabilizing livelihood prices and are often slow to implement;indirect price supervision measures tend to expand intervention in practice,and their legal boundaries are often ambiguous;and overall price control measures tend to replace management with adjustment,posing potential risks of government failure.In the future,legal reconstruction should be carried out in the following aspects:first,procedural control should be strengthened to enhance the checks and balances of price intervention measures;second,the boundaries of price intervention should be clarified,and the legality of the requirements and boundaries of price supervision measures should be scrutinized;finally,attention should be paid to market supply and demand relationships,and the scope and use of centralized pricing under the Price Law of the People's Republic of China should be restricted,and relevant laws in China should be improved to regulate market-oriented ad-justments.
