摘 要:当前,我国环境行政处罚制度变革的实践探索大体存在生态环境领域“不予行政处罚”裁量权界限不清、行政处罚与生态环境损害赔偿等责任重复适用、环境执法权“上收”与执法力量“下沉”相冲突等问题。提炼其共性特征可知,这些问题都可归结为整体主义思维缺失导致的制度变革之间的冲突与抵牾问题。鉴于此,需依循整体系统观提升生态环境领域“不予行政处罚”的规范化水平,完善行政处罚与生态环境损害赔偿等金钱类责任的折抵规则,并实现环境保护垂直管理制度改革与综合执法改革的有机衔接,以从事理与法理双重维度确保环境行政处罚制度变革的统筹性推进。The current reform of China’s environmental administrative penalty system is unsatisfactory.There are generally a series of problems,such as unclear boundaries of discretion in the field of ecological environment,repeated application of responsibilities like administrative penalties and compensation for eco-logical environment damage,and conflicts between the“collection”of environmental law enforcement power and the“sinking”of law enforcement forces.In view of this,it is necessary to follow a holistic systems approach to enhance the standardization of“not to impose administrative penalties”in the field of ecological environment,improve the rules of offsetting administrative penalties and monetary liabilities for ecological environment damage compensation,and realize the organic connection between the reform of the vertical administrative system for environmental protection and the reform of comprehensive law enforcement,thus ensuring the integrated promotion of changes in the environmental administrative penalty system from the per-spectives between logic and jurisprudence.
