摘　　要：习近平总书记关于加强新时代检察机关法律监督工作的重要论述,构成了习近平法治思想中极具本土特色的加强法律监督理论。加强法律监督理论凝聚了党的十八大以来关于法律监督的理论成果和实践经验,实现了法律监督理论的传承和创新,系统地回答了新时代为什么加强法律监督、加强什么样的法律监督、怎样加强法律监督等重大问题。其基本要义包括四个方面:功能定位论阐明了理论基点和体系逻辑;原则导向论明确了价值取向、方向道路和中心任务;监督能力论要求质效导向、数字赋能和人才驱动;监督体系论强调重点突破、体制优化和机制优化。习近平法治思想中的加强法律监督理论为新时代加强法律监督工作提供了基本方向指引和具体行动指南,具有鲜明的政治性、人民性、实践性、系统性和辩证性,实现了诸多方面的重大创新:拓展深化了“党的领导”理论,创造性提出了“四个定位”理论,充实完善了“公正司法”理论,着力探索了检察公益诉讼理论,推动了中国特色检察学理论体系的发展。Xi Jinping's important discourse on enhancing the legal oversight by procuratorial organs in the new era has shaped a theory of legal supervision with distinct local characteristics within Xi Jinping Thought on the Rule of Law.This theory,focused on strengthening legal oversight,consolidates the theoretical advancements and practical insights in legal supervision since the 18th National Congress of the Communist Party of China,fostering both continuity and innovation in legal oversight theory.It systematically addresses the rationale behind the need to strengthen legal oversight,the specific areas warranting attention and the strategies for enhancing legal supervision in the new era.The theory's core essence includes four aspects.The functional positioning theory elucidates the theoretical foundation and systematic rationale of legal oversight;the principle-oriented theory outlines the values,direction,and primary objectives of legal supervision;the supervisory capacity theory emphasizes quality,efficiency,digital integration,and talent development;the oversight system theory highlights pivotal advancements and enhancements in the legal oversight framework and mechanisms.This theory provides essential guidance and practical directives for strengthening legal oversight in the new era,characterized by its political acumen,people-oriented,practicality,systematic coherence,and dialectical reasoning.It introduces significant innovations in many aspects,expanding on the theory of"Party leadership,"introducing the concept of"four orientations,"enhancing the principles of"fair justice,"exploring public interest litigation in procuratorial practices,and advancing the theoretical framework of procuratorial science with distinctive Chinese characteristics.
