公共数据授权运营法治内涵与制度完善

摘　　要：公共数据授权运营既需要满足公共数据要素价值激发的经济性目标,又需要符合数据安全保障的底线性要求,依据法理逻辑提炼公共数据授权运营法治要点,可以在制度建设中予以全过程的原则性要求,在指导实践中形成体系化的理论支撑。分析各地方公共数据授权运营法治实践可知,当前缺乏全国性公共数据授权运营法律规制,存在公共数据授权运营行政执法体系待建立、司法建设待完善的现实问题,应当采用鼓励省级地方立法先行、运用法律激励理论开展立法、分类式界定衍生数据财产权属进行立法制度性完善,进而形成体系化公共数据授权运营行政执法规制,形成完备的公共数据授权运营司法救济途径。The authorized operation of public data not only needs to meet the economic goal of stimulating the value of public data elements but also must comply with the fundamental requirements of data security.By refining the key points of the rule of law for the authorized operation of public data based on legal logic,we can impose principled requirements throughout the system construction and form a systematic theoretical support in guiding practice.Analyzing the legal practice of authorized operation of public data in various regions,it can be seen that there is currently a lack of national legal regulation for the authorized operation of public data.There are practical issues such as the need to establish an administrative law enforcement system for the authorized operation of public data and the need to improve judicial construction.Therefore,it is necessary to encourage provincial local legislation to take the lead,apply legal incentive theories to legislation,and define the property rights of derivative data in a classified manner to improve the legislative system.This will further lead to the formation of a systematic administrative law enforcement regulation for the authorized operation of public data and establish comprehensive judicial remedies for the authorized operation of public data.
