摘 要:新行政复议法第49条明确规定了复议机关适用普通程序审理行政复议案件时,应当听取当事人的意见以及听取意见的方式。此规定不仅保障当事人参与行政程序、表达诉求的权利,更提升了复议机关作出行政决定的民主化、科学化水平。实践中,行政复议机关在审理政府信息公开、举报投诉等存在众多申请人及委托代理人的案件时,囿于案件审理期限、复议机关职能多元化、案件申请人众多性与居住分散性等因素,使得听取当事人意见程序效能无法得到有效发挥。因此,需要通过构建网络公共平台、完善行政复议代表人推选程序等举措予以化解。Article 49 of the new administrative review law clearly stipulates that the Administrative Review Body should listen to the opinions of the parties and the ways of hearing the opinions when it applies ordinary procedures to hearing administrative review cases.This provision not only protects the rights of the parties to participate in administrative procedures and express their claims,but also promotes the democratization and scientifi c level of administrative decisions made by administrative review bodies.In practice,the branches of the People's Bank of China,when handling cases involving the disclosure of government information,the reporting of complaints,etc.,due to such factors as the time limit of hearing a case,the diversifi cation of functions of the Administrative Review Body,the multiplicity of applicants and the dispersion of residence,the eff ectiveness of the procedure of hearing the opinions of the parties can not be brought into play eff ectively.Therefore,we need to build a network of public platforms,improve the procedures for the selection of representatives of Administrative Review to be resolved.
