摘　　要：随着网络信息时代发展,在线诉讼在诉讼活动中扮演着越来越重要的角色,在线庭审减轻了当事人的诉讼负担,提高诉讼效率,体现了司法为民的理念,然而在保障效率价值的同时,也对一些传统民事诉讼规则提出了挑战,如在线诉讼使司法亲历性不能得到保障,在线诉讼对传统最佳证据规则也形成了一定冲击,在线诉讼中提交的电子证据真实性也难以界定,还有在线庭审中的面临的技术问题,为回应上述挑战和风险,针对以上问题需要重新定义直接言词原则、优化证据提交和审查规则、优化在线诉讼技术,为在线质证提供规则保障,从而更方便了诉讼当事人和提高了诉讼效率。With the development of the network information age,online litigation plays an increasingly important role in litigation activities,online court hearings reduce the litigation burden of the parties,improve litigation efficiency,and reflect the concept of justice for the people,but while ensuring the value of efficiency,it also poses challenges to some traditional civil procedure rules,such as online litigation makes judicial experience cannot be guaranteed,online litigation also has a certain impact on the traditional best evidence rules,and the authenticity of electronic evidence submitted in online litigation is also difficult to define.In order to respond to the abovementioned challenges and risks,it is necessary to redefine the principle of direct speech,optimize the rules for evidence submission and review,and optimize the online litigation technology to provide rule guarantees for online cross-examination,so as to make it more convenient for litigants and improve litigation efficiency.
