比例原则在交通行政执法中的适用

摘　　要：比例原则作为现代法治国家的一大重要人文因素,它的存在前提在于行政自由裁量权的存在,它的核心思想表现为公共利益与个人利益的价值位阶排序。交通行政执法与国民的日常生活密切相关,滥用行政权力将直接影响行政相对人的个人利益和公共安全,危及公权力机关公信力和法律权威。同时,在交通行政执法领域中,行政主体所享有的自由裁量权相较于其他领域是功能更为广泛的。因此,权衡交通行政执法领域中个人利益与公共安全的关系尤为重要,比例原则在这一领域的适用中仍存在很多问题。本文就完善交通行政执法中比例原则的适用提出了几点自己的思考:确立行政比例原则;明确交通行政执法裁量基准;提高交通行政执法人员法律素养。Principle of proportionality becomes an essential human factors in modern law society,the existence of the principle comes from the existence of Administrative discretion,the core thought of it is the order of value between the self rights of administrative counterparts and the public interest.The area of the traffic administration law enforcement is relevant to our daily life,and the abuse of administrative power will directly affect the personal interests and public safety of the administrative counterpart,endangering the credibility and legal authority of the public power mechanism.Meanwhile,in the field of traffic administrative law enforcement,the discretionary power enjoyed by administrative entities has a wider range of functions compared to other fields.Therefore,it is particularly important to balance the relationship between personal interests and public safety in the field of traffic administrative law enforcement.There are still many problems in the application of the principle of proportionality in this field.This article proposes several personal thoughts on improving the application of the proportionality principle in traffic administrative law enforcement:establishing the administrative proportionality principle;clarifying the discretion standard in the traffic area;improving the quality of the law enforcement officials in this area.
