摘　　要：本文通过同多位参与开放许可试点的专利权人和专利需求者进行沟通,对其指出的适用专利开放许可面临的许可使用费定价难、激励措施缺乏吸引性、权利难以得到保障等关键问题进行分析。以专利开放许可制度的基础理论为核心,提出优化定价模式,完善激励措施和引入商事主体进行实质审查从而促进专利开放许可制度在我国的落地实施。Through the communication with a number of patentees and patent demanders participating in the open license pilot,this paper analyzes the key problems pointed out by them,such as the difficulty in pricing royalties,the lack of attractive incentive measures,and the difficulty in securing rights.Based on the basic theory of patent open licensing system,this paper proposes to optimize the pricing model,improve the incentive measures and introduce commercial subjects to conduct substantive examination,so as to promote the implementation of patent open licensing system in China.
