摘　　要：ChatGPT类产品的火爆兴起,如何平衡著作权人及ChatGPT类产品研发者的利益,使著作权限制制度的适用体系面临着极大的挑战。为满足人工智能发展对作品使用的内在要求,考虑利益平衡、市场发展等因素,应允许ChatGPT类产品适用法定许可制度向公众提供受著作权保护的作品权限。根据《WIPO版权条约》第10条声明作为依据,将ChatGPT类产品纳入到法定许可的范围内,适当借鉴些许域外国家法定许可相关的付费机制,在运行时制定相应的配套措施,交由著作权集体管理组织解决,使著作权人获得相应的报酬,ChatGPT类产品法定许可使用者违反规定不支付合理报酬,根据侵权者所得收益或著作权人的损失承担1~5倍的惩罚性赔偿金等法律责任。With the rise of ChatGPT products,how to balance the interests of copyright owners and ChatGPT product developers makes the applicable system of copyright restriction system face great challenges.In order to meet the inherent requirements of the development of artificial intelligence for the use of works,considering the balance of interests,market development and other factors,ChatGPT products should be allowed to apply the statutory licensing system to provide the public with the rights of copyrighted works.According to the Article 10 statement of the WIPO Copyright Treaty,ChatGPT products are included in the scope of statutory licenses,appropriate reference is made to some payment mechanisms related to legal licenses in foreign countries,and corresponding supporting measures are formulated during operation and submitted to the collective management organization of copyright to solve the problem,so that copyright owners can obtain corresponding remuneration.The legal licensed users of ChatGPT products who violate the provisions do not pay reasonable remuneration,and shall bear 1~5 times punitive damages and other legal liabilities according to the income earned by the infringer or the loss of the copyright owner.
