优化营商环境视域下我国公平竞争审查制度完善进路

摘　　要：优化营商环境、公平竞争审查与经济发展三者间是相辅相成的,良好的营商环境是经济发展的客观条件,公平竞争审查是保障经济健康发展的必要手段。当前,政策制定机关实施公平竞争审查制度的积极性与有效性仍有待提高,制度本身存在审查目的不完备、审查主体单一、例外规定含糊、监督体系不健全等问题。对此,我国应当及时完善公平竞争审查制度措施包括明确全体社会公众为制度受益者;在内部审查的基础上强化市场监督管理局和第三方评估机构的审查力度;与相关法律法规做好衔接明确例外规定内涵,细化例外规定具体内容;全面加强外部监督等,以此完善公平竞争审查制度,提升营商环境质量。Optimizing business environment,fair competition review and economic development are mu-tually reinforcing.A good business environment is an objective condition for economic development,and fair competition review is a necessary means to ensure healthy economic development.At present,the en-thusiasm and effectiveness of the policy making organs in implementing the fair competition review sys-tem still need to be improved,and the system itself has problems such as incomplete review purposes,in-dependent review powers,inadequate review exceptions,and imperfect review supervision.In this regard,our country should improve the fair competition review system in time,including increasing all the public as the beneficiaries of the system;On the basis of the internal review,strengthen the review of the Munici-pal regulatory Bureau and the third-party evaluation agency;Do a good job in connection with relevant laws and regulations,clearly define the connotation of exception provisions,and define the threshold value of degree terms;We will comprehensively strengthen external supervision to improve the fair competition review system and improve the quality of the business environment.
