摘 要:紧急强制作为行政主体排除紧迫状态,维护公共秩序的重要应急管理措施有超越实定法之属性,其超法规性源于自然法学派的国家自卫权。紧急强制临场处置色彩浓厚,强自主性与强封闭性激增其“滥用”风险。倚行政裁量权基准之情节细化技术规范紧急强制,通过对适用条件、适用主体、适用法律的情节细化,剔除非必要性自由裁量,对必要性自由裁量加以可行性规范,平衡紧急状态的“破”和依法行政的“守”是多元化行政应急管理的一种新尝试。Emergency coercion,as an important emergency management measure for the administrative subject to eliminate the state of urgency and maintain public order,has the attribute of surpassing the established law,and its super-legal nature stems from the national right to self-defense of the school of Natural law.The emergency compulsory on-site disposal is strong,and the strong autonomy and closure increase the risk of“abuse”.Relying on the basis of administrative discretion,the technical specifications for the refinement of the circumstances are urgently mandatory.Through the refinement of the applicable conditions,the applicable subject,and the applicable law,the non-essential discretion is eliminated,and the necessary discretion is regulated.Balancing the“breaking”of the state of emergency and the“compliance”of the administration in accordance with the law is a new attempt at diversified administrative emergency management.
