摘　　要：通过对近年来的办理的案件进行分析发现,G省司法机关对非法占用农用地罪行为人的处理呈现不捕率高、不诉率高、缓刑率高的特点,这种司法现状有理论和现实上的依据。但是,透过这种现状却能够发现行政执法力度不够、司法裁量标准尚不统一、法律有关规定等深层次问题。细化刑法有关规定、建立行政处罚“双罚制”并加大行政执法力度、统一司法裁量标准,更加注重综合治理,是加强我国农用地保护的适当路径。Through the analysis of the cases handled in recent years,it is found that the handling of the crime of illegal occupation of agricultural land presents the characteristics of high non-arrest rate,high non-prosecution rate and high probation rate.This judicial situation is based on theory and reality.However,through this situation,we can find that the administrative law enforcement is not enough,the judicial discretion standards are not unified,the relevant legal provisions and other deep-seated problems.It is the appropriate path to strengthen the protection of agricultural land in China to refine the relevant provisions of the criminal law,to establish the"double punishment system"of administrative punishment,to unify the judicial discretion standards,and to pay more attention to comprehensive management.
