摘　　要：我国于2011年新增危险驾驶罪,醉驾入刑至今已有十余载。同样,世界各国也一直在围绕酒驾立法,尤其是刑事立法,尝试各种策略,以遏制酒驾现象。因而相关措施是否有效,以及如何测量和评估其实效,就成了关键问题。而解决问题的前提,在于梳理和明确当前国际和国内酒驾犯罪规制的总体趋势、实际效果及测量方法,以为后续选择合适的方法和标准衡量酒驾刑事立法的效果奠定基础。目前,全球酒驾规范总体趋势为由宽到严,相反,我国为由严到宽。有关酒驾刑事立法实际效果的外文研究成果较多且视角与方法更为多样化,而中文相关研究较少,现有研究视角单一,论证方法简单,相关研究理论也较为单薄。不过,中外文研究结论均未达成一致。通过分析中外酒驾立法趋势和实效研究,并参考现有外文酒驾犯罪研究成果的理论视角和测量方法,能够更加精确地检验我国醉驾型危险驾驶罪立法的实际效果,并从中获得关于改良醉驾型危险驾驶罪立法及司法实践的出路。China added the act of driving under influence(DUI)in criminal law in 2011.Drunk driving has been punished for more than ten years.Similarly,most states try some strategies of legislation,especially criminal legislation,to contain the phenomenon of dangerous driving under influence.Therefore,whether the related strategies and measures are effective,and how to measure and assess their practical effects become key issues.To study these issues,the premise is to analyze current international and domestic holistic tendencies,practical effects and measuring methods of regulations about driving under influence.It lays the foundation for selecting appropriate methods and criteria to measure the effect of criminal legislation.At present,global regulations tendency of driving under influence is from loose to strict,but domestic regulations tendency is just the opposite.The research concerning the practical effects of drunk-driving legislation showed that there are more international research achievements,more research perspectives and more research methods compared to domestic research which is much less,showing single research perspective,simple argumentation method and less theories.In addition,the research concerned from both at home and abroad exhibited no consensus on the conclusions.Through a comparison of domestic and international drunk driving legislation trend and practical effect,it is a feasible method to refer to the theoretical perspective and measurement methods of the existing foreign research achievements on drunk driving crime.Based on this,Chinese practical effects of drunk driving will be accurately examined and improving strategies of legislation and judicature will be discovered.
