关于公共科研机构应对开源中知识产权问题的思考

摘　　要：开源在创新迭代、生态拓展和国际化发展等方面可以起到积极作用,但科研院所、大学等公共科研机构在将成果进行开源或者参与建设开源社区等活动时,面临着国有资产管理、知识产权处置、法律风险防控等方面的问题。文章从开源项目的捐赠、开源许可证的选择、开源专利池的构建等几个方面,为应对上述问题提供一些思考和建议。Open source plays a positive role in terms of innovation iteration,ecological expansion,and international development.Nevertheless,when trying to open source scientific research achievements,or to participate in the construction of open-source communities,public scientific research institutions encounter open source related problems such as losses of state-owned assets,disposal of intellectual property right,legal risks prevention and control,etc.The authors put forward proposals from the following aspects:donation of open source projects,selection of open source license,and construction of open source Patent Pool.
