摘 要:现代正义理论奠基于权利正义的框架之内,独立个体就是这种正义范式的理论预设。黑格尔从财产权批判的理论进路,指认个体正义范式不过是市民社会正义观念的自我表述,马克思破除了按要素分配原则的正义幻象,澄清了市民社会正义意识形态所遮蔽的产权私有本质。黑格尔认为国家正义范式能够“超越”市民社会的利益纠葛,而马克思强调,基于市民社会的“伦理共同体”依然是一种“虚幻的共同体”,根本无法达成个体与共同体之间的真正“和解”。马克思依托“自由人联合体”的社会形态,勾勒出“各尽所能、按需分配”的正义图景,真正开启了一种能够促成个体互惠合作的共同体正义范式,从而为我国开启的共同富裕道路提供了学理支撑。The modern justice theory is based on the framework of the right of access to justice,and the independent individual is the theoretical presupposition of this paradigm of justice.Hegel points out that the paradigm of individual justice is only the self-expression of the concept of justice of a civil society from the critical theory of property rights,and Marx breaks the illusion of justice according to the principle of distribution of factors and clarified the private nature of property rights covered by the ideology of justice of a civil society.Hegel believes that the paradigm of national justice can“transcend”the interests of a civil society,while Marx emphasizes that the“ethical community”based on a civil society is still an“illusory community”and it is impossible to achieve a real“reconciliation”between individuals and communities.Relying on the social form of“the association of free men”,Marx outlines a picture of justice of“from each according to his ability,to each according to his needs”,which has really provided a paradigm of community justice that can promote individual reciprocal cooperation,thus providing some theoretical support for the road of shared prosperity opened by China.
