摘　　要：面对数字图书馆建设的国际性潮流与公众获取知识信息的时代需要,值得我们重新审视图书馆数字化建设行为的合理性本质。论文通过对数字图书馆建设的版权侵权风险、我国版权例外适法困境、典型国家例外制度的分析,提出从馆藏作品数字化例外、馆外资源数字化例外、图书馆TDM例外等三方面具体构建我国图书馆数字化建设版权例外规则的策略。In the face of the international trend of digital library construction and the public's access to knowledge and information,it is worthwhile for us to re-examine the rationality of the library's digital construction behaviour.By analysing the risk of copyright infringement in digital library construction,the dilemma of copyright exceptions in China and the exception system of typical countries,the thesis proposes a strategy to construct the copyright exception rules for digital library construction in China from the three aspects of digitisation exceptions for collected works,digitisation exceptions for extra-library resources and TDM exceptions for libraries.
