摘　　要：正义何以被需要,即正义的环境是什么,正义的“超越性”如何理解,超越性正义理论有何特质,这是马克思主义超越性正义理论建构需要回答的基本问题。建构马克思主义超越性正义理论应以重释休谟-罗尔斯提出的“正义的环境”为逻辑前提,把物质资源匮乏与人性偏私看作正义超越的对象而非正义永恒的基点。马克思主义超越性正义理论之“超越性”是指超越不正义的社会现实、超越具体的正义原则与观点、超越正义本身。由此,正义的现实化、正义的边界、正义的消亡构成马克思主义超越性正义理论的核心论题。马克思主义超越性正义理论的主体内容呈现出“正义的环境”的复杂性、正义评价与实践主体的动态性、正义规范尺度的历史性、正义关涉领域的贯通性、分配正义原则的交替性、正义社会的可经验性。Why is justice needed?What is the environment for justice?What is the solution to the transcendence of justice?And what are the characteristics of transcendent justice theory?These are three fundamental questions that need to be answered in the construction of Marxist transcendent justice theory.The construction of Marxist transcendent justice theory should be based on the logical premise of reinterpreting the"just environment"proposed by Hume Rawls,and regard the scarcity of material resources and human bias as the objects of justice transcendence rather than the eternal basis of justice.The transcendence of Marxist theory of transcendent justice denotes transcending the social reality of injustice,transcending specific principles and viewpoints of justice,and transcending justice itself.Thus,the realization of justice,the boundaries of justice,and the extinction of justice constitute the core thesis of Marxist transcendent justice theory.The main content of Marxist transcendent justice theory presents the complexity of the"just environment",the dynamism of justice evaluation and practice subjects,the historicity of justice norms,the continuity of justice related fields,the alternation of distributive justice principles,and the empiricism of a just society.
