将国际法作为国际关系的语言——国际法教学与研究的战略视角

摘　　要：世界正处于百年未有之大变局。国际秩序是“以规则为基础”还是“以国际法为基础”成为各国的关注。在这一时代背景下,重新审视联合国长期协助各国“推广国际法教学、研究和传播”的实践,重温联合国国际公法大会曾提出的“将国际法作为国际关系的语言”的论断,能够启发我们对国际秩序基础之争的深入思考。国际法在新时期塑造全球秩序动态发展的作用,以及中国在国际调解理论发展方面的贡献,需要有更深入的研究。中国共创和谐的调解实践,丰富了国际法和平解决争端的理论,开辟了新的研究方向,包括国家对国际法发展的影响、不同文明和文化对国际法发展的作用、亚洲文化在塑造21世纪国际法过程中扮演的角色等新的课题。现代国际法发展与变化的趋势为国际法的教学和研究提供了新的路径。Facing up to a changing world,countries need to make choice while dealing with international affairs:"Should we maintain an international order based on international law"or an international order based on the so-called‘rules'"?At this critical moment,to review the United Nations'practice in'promoting the teaching,research and dissemination of international law"and to rethink the concept of international law as a language for international relations"can inspire us to think deeply about the contemporary issue of the struggle for international order.China's practice of creating harmonious mediation has enriched the theory of peaceful settlement of disputes under international law and opened up new research directions.These include the influence of countries on the development of international law,the role of different civilizations and cultures on the development of international law,and the role of Asian culture in shaping international law in the 21st century.The conclusion is that the development and changing trends of moderni nilternational law providee new Jpath for teaching and research of international law.
