美国转换性使用规则对我国图情档领域合理使用著作权立法的启示

摘　　要：转换性使用规则对解决美国图情档领域著作权问题作用明显。由于中美两国在合理使用制度的立法基础、模式、具体规定和司法实践标准方面的差异,同样类型的图情档领域著作权案件在中国的判决结果却不同。把转换性使用规则引入我国著作权制度有利于创新图情档领域的著作权立法、完善图书馆档案馆服务功能、推动图情档领域信息资源开发。基于此,本文探讨了我国图情档领域转换性使用规则的立法进路,具体包括:设置合理使用的一般条款、适时补充合理使用的清单、扩大解释现行的法律规定等。The rules of transformative use have a significant impact on solving copyright issues in the field of image and information in the United States.Due to the differences between China and the United States in the legislative basis,model,specific provisions and standards of judicial practice o f fair use system,the same type of copyright cases in the field of picture and picture Archives in China have received different results.The introduction of the transformational use rules into China's copyright system is conducive to the innovation of copyright legislation,the improvement of library Archives service functions,and the promotion of the development of information resources in the field of library Archives.This paper further discusses the legislative approach to the transformational use of rules in the field of picture and information files,it includes:setting up the general terms of reasonable use,supplementing the list of reasonable use in a timely manner,expanding the interpretation of existin g legal provisions,etc.
