征地补偿费分配纠纷中的成员资格争议及司法判定——基于浙江省245份裁判文书的实证分析

摘　　要：成员资格认定是确定征地补偿费分配对象的前置条件,而当前成员资格认定缺乏统一标准,由此引发了较多的分配纠纷。本研究以浙江省2019—2022年由成员资格争议引发的245例征地补偿费分配纠纷案件为研究对象,基于扎根理论和判决文书统计方法,分析成员资格争议类型及司法判定结果,为我国其他省份征地补偿费分配纠纷中成员资格争议的司法判定提供思路。结果表明:(1)征地补偿费分配纠纷中的成员资格争议包括成员资格取得争议、成员资格保留争议和成员资格丧失争议。(2)司法判定取得成员资格的依据包括直接依据和间接依据,实践中最常用的是直接依据+间接依据的形式。(3)司法判定丧失成员资格的情形主要有:依村规民约已经享有了一次性补偿;不再以本集体经济组织土地为生存保障;已取得其他经济组织成员权益。因此,我国其他省份可以借鉴浙江省的司法裁定路径,区分成员资格争议类型,规定成员资格的取得依据及丧失情形,提高司法的公平性。Membership identification is a prerequisite for determining the distribution object of land expropriation compensation.However,the current membership identification system lacks uniform standards,which leads to more distribution disputes.This study takes 245 cases caused by membership disputes in Zhejiang Province from 2019 to 2022 as the research object.Based on the grounded theory and the statistical method of judgment documents,it analyzes the types of membership disputes and the results of judicial determination and provides ideas for the judicial determination of membership disputes in land acquisition compensation disputes in other provinces.The results show that:(1)the dispute of membership in the distribution dispute of land ex propriation compensation includes the dispute of membership acquisition,the dispute of membership retention,and the dispute of membership loss.(2)The basis for obtaining membership in judicial judgment includes a direct basis and an indirect basis.The most commonly used form in practice is the combination of direct basis and indirect basis.(3)The main reasons for the loss of membership are:according to the village rules and regulations,members have enjoyed one-time compensation they no longer take the collective economic organization the land of a survival guarantee:and they have obtained the rights and interests of other members of economic organizations.Therefore,other provinces can learn from Zhejiang s judicial judgment path,distinguish the types of membership disputes,stipulate the basis and loss of membership,and improve the fairness of justice.
