摘  要:集体经营性建设用地使用权抵押是弥补乡村发展资金缺口的重要方式。在集体经营性建设用地中,满足入市条件的乡镇、村企业建设用地使用权可以单独抵押;集体土地所有权人也可以直接将集体经营性建设用地使用权进行抵押。集体经营性建设用地使用权抵押权的设立以集体经营性建设用地所有权和使用权的登记为必要前提,抵押权自抵押登记时设立。集体土地所有权人抵押集体经营性建设用地使用权以通过本集体经济组织成员表决为必要条件。鉴于土地使用权和建筑物是具有独立交换价值的产权单位,抵押人可以就建设用地使用权和地上建筑物分别抵押,但抵押权人仅可就其登记的抵押物的变价款优先受偿。在抵押权实现时,集体成员对被处分的集体经营性建设用地使用权不享有优先购买权。The mortgage of the right to the use of collective commercial construction land is an important way to make up for the funding gap of rural development.In the collective management of construction land,township and village enterprises that meet the market conditions for the right to the use of construction land shall be mortgaged separately;The owner of collective land can also use the right to the use of collective commercial construction land as mortgage.The establishment of the mortgage of the right to the use of the collective commercial construction land is based on the registration of the ownership and use right of the collective commercial construction land,and the mortgage is established at the time of registration of the mortgage.It is necessary for the owner of the collective profit-oriented construction land to mortgage the right to use the collective profit-oriented construction land for approval by the members of the collective economic organization.In view of the fact that the land use right and the house property right are independent property rights units with exchange value respectively,the mortgagor may mortgage the construction land use right and the above-ground building respectively,and the mortgagee may only have priority in compensation for the conversion price of the mortgage subject matter registered with him.When the mortgage right is realized,the internal members of the collective shall not have the priority to transfer the right to use the collective commercial construction land that is disposed of.
