元宇宙技术下网络隔空性侵入刑之反思

摘　　要：元宇宙对世界的改变侧重于社会性的侧面,无论是融合现实还是脑机互联,元宇宙都无法改变人的生物属性,而建基于生物属性之上的身体行动,则属于元宇宙辐射力鞭长莫及的领域。性依托生命而存在,性侵也只能以生物身体为载体。性侵需要物理在场与身体在场,但由于元宇宙空间无法容纳肉身,而且隔空猥亵的论证无法替换至性侵,因而网络隔空性侵自始不可能。对元宇宙技术下网络隔空性侵的肯定论,依靠的是概念的混淆、共犯的忽略与法益侵害的嫁接,并没有真正实现网络隔空性侵与传统性侵的等价式论证。网络隔空性侵的命题抽离了生物身体,企图用高度接近现实的元宇宙和脑机互联设备诠释其危害性并进行等价处理,但由于底层逻辑已然改变,其注定无法成功。我国对网络隔空性侵有充足的刑法规范供给,并不存在规制漏洞,没有修法必要。进行场景还原后发现,网络隔空性侵实质上并未隔空,而是在场,造成此种偏差认知的原因是不当的事实归纳与规范适用。围绕元宇宙展开学术思考与前沿探索应着眼于具有社会价值的真问题,避免落入纯技术窠臼与偏颇的假问题泥淖。学术遐想不能脱逸社会现实,学术想象力也需要恪守边界意识,而作为生命存在的人与亘古不变的人性则是这面边界之墙的基石。The changes made by the metaverse to the world focus on social aspects.Whether it is the fusion of reality or the interconnection of brain and computer,the metaverse cannot change human biological attributes.However,physical actions based on biological attributes belong to the field beyond the reach of the radiation force of the metaverse.Sex exists through life,and sexual assault can only be carried by biological bodies.Sexual assault requires physical and physical presence,but due to the inability of the metaverse space to accommodate physical bodies and the inability to replace the argument of space based obscenity with sexual assault,online space based sexual assault was initially impossible.The affirmation of cyberspace sexual assault under metaverse technology relies on confusion of concepts,neglect of accomplices,and grafting of legal interest infringement,but it does not truly realize the equivalence between cyberspace sexual assault and traditional sexual assault.The proposition of cyberspace sexual assault has detached the biological body,attempting to interpret harmfulness with highly realistic metaverse and brain computer interconnection devices,and attempting to treat it equivalently.However,due to the change in underlying logic,it is destined to fail.China has sufficient criminal law regulations for cyberspace sexual assault,but there are no regulatory loopholes and there is no need to amend the law.After conducting scene restoration,it was found that the network intrusion was not actually isolated,but rather present.The reason for this biased cognition was improper factual induction and normative application.Academic thinking and cutting-edge exploration around the metaverse should focus on real problems with social value,avoiding falling into pure technical stereotypes and biased pseudo problem quagmire.Academic imagination cannot escape from social reality,and academic imagination also needs to adhere to the consciousness of boundaries.As a living entity,human nature and the eternal and unchangin
