论习近平文化思想视野下的文化权利体系的制度建构

摘　　要：由于缺少明确和完整的科学理论指引,传统法学理论下的文化权利在法理上尚无有效的制度架构。在实践中,文化权利对文化事业的参与度较弱,文化权利所保护的法益具有很大的不确定性,特别是无法形成一种具有可诉利益的法定权利。从分析习近平文化思想的“七个着力”核心要义出发,以“七个着力”为指导,可以进一步增强文化权利自身的法理逻辑性和文化权利层次的丰富性,便于构建清晰的文化权利制度体系,强化实践对文化权利的法治保障能力。本文提出了八项集体人权意义上的文化权利与十项个人人权意义上的文化权利,这些文化权利相互作用、相互补充,通过结合习近平文化思想与习近平法治思想的各项要求,可以为保障文化权利的有效实现提供科学的制度路径。It points out that due to the lack of clear and complete scientific theoretical guidance,cultural rights have not yet established an effective institutional framework in legal theory.In practice,the participation of cultural rights in cultural undertakings is weak,and the legal interests protected by cultural rights are highly uncertain,especially in the inability to form a legal right with actionable interests.Starting from the analysis of the core essence of the“seven focuses”of Xi Jinping Thought on Culture,this article points out that guided by the“seven focuses”of Xi Jinping Thought on Culture,it can further enhance the legal logic of cultural rights and the richness of cultural rights levels,facilitate the construction of a clear cultural rights system,and strengthen the ability of practice to safeguard cultural rights under the rule of law.This article puts forward eight cultural rights in the sense of collective human rights and ten cultural rights in the sense of individual human rights.These cultural rights interact and complement each other.And by combining the requirements of Xi Jinping Thought on Cultural and Xi Jinping Thought on the Rule of Law,it can provide a scientific institutional path for ensuring the effective realization of cultural rights.
