粮食安全战略中的粮食流通行政执法探析

摘　　要：行政执法是推动粮食流通现代化的重要法律制度,具有特定性、职权性、程序性、裁量性的鲜明特征,可类型化为行政许可、行政备案、行政检查、行政处罚、行政强制等方式。通过行政执法有助于贯彻粮食流通法律规范、维护粮食流通秩序、保护公众合法权益、保障国家粮食安全。目前粮食流通行政执法尚有不足,具体表现为主体单一且能力偏弱、行为方式失范、程序不够规范以及保障相对欠缺。为完善该项制度,一要以协同执法开拓监管新模式,粮食行政管理部门加强与其他部门、社会力量的协作;二要运用法律解释机制进行优化,确保行为方式的合理性;三要构建“平战结合”的程序,促进常规程序与应急程序并重;四要塑造多元化的保障机制,改进信息技术、监督协调、行刑衔接等措施。Administrative law enforcement is an important legal system for promoting the modernization of grain circulation,with distinct characteristics of specificity,authority,procedure,and discretion.It can be classified into administrative licensing,administrative filing,administrative inspection,administrative punishment,administrative coercion,and other methods.Administrative law enforcement helps to implement legal norms for grain circulation,maintain grain circulation order,protect the legitimate rights and interests of the public,and ensure national grain security.There are still shortcomings in the current administrative law enforcement for grain circulation,which are manifested as a single subject with weak capabilities,misconduct,inadequate procedures,and lack of protection.To improve this system,firstly,we need to explore new regulatory models through collaborative law enforcement,and the grain administrative department should strengthen cooperation with other departments and social forces.Secondly,we need to optimize the use of legal interpretation mechanisms to ensure the rationality of administrative law enforcement actions.Thirdly,we need to establish an administrative law enforcement procedure that combines"peacetime and wartime",promoting equal emphasis on routine procedures and emergency procedures.Lastly,we need to shape a diversified administrative law enforcement guarantee mechanism,and improve such measures as information technology,supervision and coordination,and execution coordination.
