国家公园社区共管的实践现状与法治路径探析

摘　　要：目前我国国家公园社区共管制度仍处于探索阶段,通过梳理各园区实践现状总结出法律制度供给不足、央地事权划分不清、社会参与程度不够和园内区域发展不均等诸多问题,为实现缓解保护与生存使用的矛盾、推进国家公园共管制度科学建设,提出建设完善的法律体系、界定明晰的央地职权、促进多元的社会参与和增进协调的区域发展等解决思路,为完善国家公园社区共管制度、实现国家公园的顶层设计提供一得之见。At present,community co-management system in China's national parks is still in the stage of exploration.By sorting out the status of practice in each park,it summarizes many problems such as insufficient supply of the legal system,unclear division of rights between central and local authorities,insufficient public participation,and uneven regional development in the park.In order to alleviate the contradiction between protection and utilization,and promote scientific construction of national park co-management system,we put forward solutions such as building a perfect legal system,clear definition of rights of central and local authorities,promoting diversified public participation,and enhancing coordinated regional development,so as to provide a good idea for improving the community co-management system of national parks and realizing top-level design of national parks.
