摘　　要：随着法治建设的持续深化,刑事诉讼程序日益强调对犯罪嫌疑人、被告人合法权益的保障。值班律师作为该程序的关键参与者,其角色定位与功能发挥对于维护被追诉人权益、推动司法公正具有重要意义。在当前的司法体制改革浪潮中,关于值班律师的角色定位究竟是“法律帮助者”还是“辩护人”,引发了广泛的讨论。同时,值班律师制度在司法实践中出现了履职重心发生偏移、诉讼程序间衔接不顺畅以及值班律师的收益与其承担的职责之间存在明显失衡等问题。为了确保值班律师职能的实质化,应及时查漏补缺,明确值班律师的精准定位,充实其权利内容,界定其职能范围,进一步完善值班律师的保障机制。通过多方协同,补齐值班律师制度中的短板,更好地发挥其在诉讼中的积极作用。With the continuous deepening of the construction of the rule of law,the criminal procedure has increasingly emphasized the protection of the legitimate rights and interests of criminal suspects and defendants.As a key participant in this procedure,the role positioning and function of duty lawyers are of great significance for safeguarding the rights and interests of the prosecuted and promoting judicial justice.In the current reform of judicial system,the question of whether the role of duty lawyers is"legal helper"or"defender"has triggered extensive discussions.At the same time,the duty lawyer system has encountered problems in judicial practice,such as deviations in the focus of duty performance,poor coordination between litigation procedures,and a significant imbalance between the benefits of duty lawyers and their responsibilities.To ensure the substantive functioning of the duty lawyer system,it is necessary to promptly identify and rectify deficiencies,clarify the precise positioning of duty lawyers,enrich their rights,define their functional scope,and further improve the safeguard mechanism for duty lawyers.Through multi-party collaboration,we can address the shortcomings in the duty lawyer system and better leverage their positive role in litigation.
