摘　　要：完善社会矛盾纠纷多元预防调处化解综合机制,实现纠纷的源头治理是社会治理的重要内容。通过法律规则内化、民间权威整合与体制资源衔接,村级组织调解优势进一步凸显。同时,乡村纠纷治理也以强化村级组织功能为突破口形成了整合型纠纷解决机制,助推基层多元纠纷解决体系由“平面结构”向“立体结构”演进。具体表现为:1.村级组织调解嵌入到正式解纷制度之中,借助体制性身份的赋权,村干部具备了更强的纠纷调解能力与调解权威;2.村干部既可以立足国家法治权威并灵活援引人情、面子、道义等地方性知识实现矛盾纠纷的化解,又可以通过制度渠道调动正式法治资源,形成融合法治规则与基层治理目标的情、理、法纠纷调解连续体,从而达到“息讼止争”与依法治理的平衡,缓解纠纷治理目标与法治化要求之间的张力;3.村级组织调解定位的变迁集中体现了国家法治与乡村司法的进一步衔接与融通,有助于多元协同型诉源治理格局的形成。It is an important part of social governance to improve the comprehensive mechanism of multiple prevention,mediation and resolution of social conflicts and disputes,and to realize the source governance of disputes.Through the internalization of legal rules,the integration of folk authority and the connection of institutional resources,the advantages of village-level organization mediation are further highlighted.At the same time,the governance of rural disputes has also formed an integrated dispute resolution mechanism with strengthening the function of village-level organizations as a breakthrough,which has promoted the evolution of the multi-dispute resolution system at the grass-roots level from"plane structure"to"three-dimensional structure."The specific performance is as follows:1.Village-level organization mediation is embedded in the formal dispute resolution system,and with the help of institutional identity empowerment,village cadres have stronger dispute mediation ability and mediation authority;2.Village cadres can not only be based on the authority of the national rule of law and flexibly invoke local knowledge such as human feelings,face and morality to resolve conflicts and disputes,but also mobilize formal legal resources through institutional channels to form a continuum of emotion,reason and law dispute mediation that integrates the rules of the rule of law and the objectives of grass-roots governance,so as to achieve the balance between"resolving disputes and settling disputes"and governance according to law,and alleviate the tension between the objectives of dispute governance and the requirements of the rule of law.The change of the mediation positioning of village-level organizations embodies the further connection and integration of the national rule of law and rural justice,which is conducive to the formation of a multi-coordinated litigation source governance pattern.
