摘 要:行政性垄断是转型国家共有的现象。在我国经济转型过程中,行政性垄断最初形态是“地区封锁”。《反垄断法》出台前,国家单独发布了针对“地区封锁”的行政法规。但是,这一制度因其层级所限,实施效率未能充分展现出来。而《反垄断法》中因规制行政性垄断的手段和程序不尽合理,同样未能实现制度的预期目标。在新时代,基于国内外经济环境的变化,加快建立全国统一大市场具有紧迫性和全局性。有必要以《反垄断法》为中心,吸收“地区封锁”制度中的合理措施,并重塑“行政—行政”监督关系、“司法—行政”监督关系,从而建立与全国统一大市场相适应的制度规则体系,以实现上述政策目标。Administrative monopoly is a common phenomenon in transition countries.In the process of our country's economic transformation,the initial form of administrative monopoly is""regional blockade".Before the introduction of the Anti-monopoly Law,the oficial issued an administrative regulation on"regional blockade"separately.However,due to the limited level of this system,the implementation efficiency has not been fully demonstrated.In the Anti-monopoly Law,the measures and procedures of regulating administrative monopoly are somewhat unreasonable,which also lead to the failure to achieve the expected goal of the system.In the new era,due to the changes in the economic environment at home and abroad,it is urgent and overall significant to"accelerate the establishment of a national unified large market"To achieve the policy goals above,it is necessary to take the Anti-monopoly Law as the center,reasonably absorb the proper measures in the"regional blockade"system,and reshape the"administrative-administrative"supervision relationship and"judicial-administrative"supervision relationship,to establish a regulation system that is compatible with the national unified big market.
