摘　　要：《土地管理法》第七十八条修正后,农村村民违法占地建住宅的执法职责在农业农村主管部门和自然资源主管部门之间出现了难以协调的困局,尤其是对于“土地”和“住宅”的理解,存在重大分歧,司法实践中也呈现出三种不同的裁判思路。基于体系解释和目的解释,第七十八条中的“土地”的内涵应当与第七十七条保持一致,即指全部类型的土地,不应以地类界分执法主体;基于文义解释和目的解释,“住宅”兼具居住和财产属性,不宜以单一的属性进行认定。因此,农村违法占地建住宅的执法职责宜交由农业农村部门。上述法解释方案不仅满足理论自洽,而且与当下综合行政执法改革的实践逻辑相契合,具有充分的现实基础。After the amendment of Article 78 of the Land Administration Law,there has been a difficult coordination dilemma between the agricultural and rural authorities and the natural resources authorities regarding the enforcement duty of illegal land occupation by rural villagers.In particular,there are significant differences in the understanding of“land”and“residence”,and there are three different judgment approaches in judicial practice.Based on the perspective of system interpretation and purpose interpretation,the connotation of“land”in Article 78 should be consistent with Article 77,that is,all types of land,of which the law enforcement bodies should not be divided by land categories;From the perspective of literal interpretation and purpose interpretation,“residence”has both residential and property attributes,which should not be identified by a single criterion.Therefore,the law enforcement duty of illegal land occupation and housing construction in rural areas should be entrusted to the agricultural and rural departments.The above legal interpretation scheme not only has theoretical consistency,but also conforms to the practical logic of the current comprehensive administrative law enforcement reform,and has sufficient practical basis.
