网络平台行为规制中的基本权利私人间效力论之否定

摘　　要：对于我国应否接受基本权利私人间效力论,并将其运用于近年来热议的网络平台行为规制当中,有必要从实践角度提供参考。基本权利私人间效力论之实践,主要包括立法和司法机关在基本权利保护的指引下进行民事立法和司法,以及有权机关对立法和司法机关基本权利保护义务履行之审查。基本权利私人间效力论本欲全面实现基本权利的价值、完善部门法的实施,并更有效地保护基本权利。但相关实践不仅无法实现其目标,反而导致基本权利价值贬损、部门法的独立性和法的安定性受到破坏,并不利于基本权利的保护。通过实践考察及反思可以明确,我国没有也不应将网络平台视为宪法约束对象,应坚持在部门法框架内调整网络平台私益冲突。As to whether China should accept the theory of horizontal effect of constitutional rights and apply it to the regulation of network platform behaviors,which has been hotly debated in recent years,it is necessary to provide references from a practical point of view.The practice of horizontal effect of constitutional rights mainly includes conducting civil legislation and justice under the guidance of the protection of constitutional rights,as well as the review of the fulfillment of the obligations of the legislature and the judiciary in the protection of constitutional rights by the competent authorities.The theory of horizontal effect of constitutional rights is intended to fully realize the value of constitutional rights,to improve the implementation of sectoral laws and ultimately to protect constitutional rights more effectively.But the relevant practice not only fails to achieve its goal,but also leads to the depreciation of the value of constitutional rights,undermining of the independence of sectoral laws and the stability of the law,and is not conducive to the protection of constitutional rights.It is clear from the practical investigation and reflection that China does not and should not consider online platforms to be constitutionally binding,and should insist on adjusting the network platforms'private interest conflicts within the framework of sectoral laws.
