摘  要:流域生态环境问题所具有的跨区域性、系统性、复杂性等特征表明其治理之难,我国沿江经济和工业化的快速发展使得流域生态环境问题变得更加突出。虽然《中华人民共和国行政诉讼法》确立了流域环境行政公益诉讼制度,但是实践中依然出现流域跨行政区划检察机关管辖错位、流域环境行政公益诉讼案件推进难度大以及流域生态环境损害救济不及时等问题。鉴于此,有必要设立流域跨行政区划专门检察机关、构建流域环境行政公益诉讼的跨区域协同机制、探索流域环境行政公益诉讼的新范式以完善我国流域环境行政公益诉讼制度。Managing eco-environmental issues in watersheds is challenging due to their trans-regional,systemic and complex nature.The rapid development of China’s riverine economy and industrialization has aggravated these problems.Although China’s Administrative Procedure Law establishes the environmental administrative litigation system for public interest,many problems still arise in practice.Such problems include the misplaced jurisdiction of prosecutors across administrative divisions,the difficulty in promoting the litigation cases of environmental administrative public interest,and the lack of timely relief for ecological damage in watersheds.To address these issues and improve the litigation system of environmental administrative public interest in China’s watershed,it is essential to establish specialized prosecution services across administrative divisions,build a cross-regional coordination mechanism and explore a new paradigm for environmental administrative litigation of public interest in the watershed.
