公民投票的民粹化图景及其隐忧

摘　　要：在民粹主义的渗透下,公民投票逐渐沦为政治博弈中首选的合法性工具,各党派希望通过主导公投走向来标榜“公意”,进而为自己“造势”。公投民粹化是公投的一种不良倾向,是指无视客观标准,基于“人民”与“精英”的对立思维,刻意抬高、美化并利用公投集会参与形式的观点及行为。公投民粹化在理论认知层面表现为对公投的盲目推崇,在制度实践层面表现为公投工具化。公投理论建构的缺失,无法抑制民粹主义蔓延;而民粹主义对公投的渗透,反过来引发公投理论的混乱,并阻碍公投理论的制度建构进程。完善公民投票的理论建构与制度建设才能消解公民投票中的民粹主义要素,促使公民投票的理性回归。Under the infiltration of populism,referendums have become the preferred tool of legitimacy in political games,and parties hope to dominate the direction of referendums in order to boast"public will",and then"build momentum"for themselves.The populism trend of referendum,a negative tendency of referendum,refers to the disregard of objective criteria,based on the antagonistic thinking of"people"and"elites",and the deliberate elevation,glorification and use of the form of participation in referendum rallies.At the level of theoretical cognition,it is manifested in the blind admiration for referendum.At the level of institutional practice,it is manifested in the instrumentalization of referendum.The lack of theoretical construction of referendum does not help to curb the spread of populism.The infiltration of populism into referendum,in turn,triggers confusion in the theory of referendum and hinders the process of institutionalization of the referendum theory.Only by perfecting the theoretical construction and system construction of the referendum can the populist elements in referendums be dissolved,and the rationality of referendums be restored.
