从“法律适用”到“法治治理”:法学专业实践模式的迭代升级

摘  要:法学专业实践之于法学教育和人才培养具有基础性意义,并应随着国家法治建设战略顺势而变。在国家治理大格局和世界百年未有之大变局背景下,随着我国全面依法治国战略的纵深推进,顺应“良法善治”法治观,法学专业实践有必要在“法律适用型”模式的基础上,迭代升级到“法治治理型”专业实践模式。法治治理型实践模式体现了包容性法治的基本理念,有助于“法治人才”治理能力的全面培养。法治治理型实践模式需在法律适用型模式的基础上,从实践理念(目的)、实践场景、实践能力、实践角色、实践环节和实践基地等维度展开制度构建。The practical aspect of law majors holds fundamental significance for legal education and talent cultivation,and should evolve in line with the national strategy of building the rule of law.Amidst the broader context of national governance and the great changes unseen in a century,as China's comprehensive strategy of governing the country according to law advances further,it is necessary for the practical aspect of law majors to iteratively upgrade from the"legal application-oriented"model to the"rule of law governance-oriented"professional practice model,in accordance with the concept of"good laws and sound governance."The rule of law governance-oriented practice model embodies the basic idea of inclusive rule of law and contributes to the comprehensive cultivation of governance capabilities among"legal talents."Building upon the legal application-oriented model,the rule of law governance-oriented practice model requires institutional construction across dimensions such as practical objectives,practical scenarios,practical abilities,practical links,practical roles,and practical bases.
