摘 要:公安民警在制止违法犯罪行为等执法活动中面临的人身安全风险高,使用警棍、辣椒水等常规警械制服暴力行为的效果有限。已有部分地方公安机关试点使用警用电击枪处置暴力行为,但电击枪的“警用”身份在法律上尚属模糊。警用电击枪的性质应归属于非致命警械,其性能相较于现有警械武器具有快速制服与最小伤害的优势。国外对警用电击枪的法律规则主要集中于使用程序、使用条件与管理制度等方面。我国应从立法确定其警械名分,明确警用电击枪的使用条件与使用程序,在健全警用电击枪使用监督机制等方面予以规范。Police officers face high personal safety risks in law enforcement activities such as stopping illegal and criminal activities,and the effectiveness of using conventional police equipment such as batons and chili water to suppress violent behavior is limited.Some local police departments have piloted the use of police stun guns to deal with violent acts,but the status of stun guns has not yet been determined by legislation.The nature of police stun guns should be attributed to non-lethal police equipment,and their performance has the advantages of fast braking and minimal damage compared to existing police equipment and weapons.The legal rules for police stun guns in the countries other than China mainly focus on usage procedures,usage conditions,and management systems.Our country should legislate to determine the classification of police stun guns,standardize the conditions and procedures for their use,and improve the supervision mechanism for the use of police stun guns.
