摘  要:高校独立法人地位及现有制度设计矛盾,制约着高校体育资源社会参与的积极性和实践效果。基于理论与现实的逻辑考量,从独立法人视角探讨高校体育资源社会参与的现实羁绊。面对高校体育资源社会参与限制与鼓励的矛盾、保值与减值的冲突、收益与风险的抵触,应在回归高校独立法人地位的前提下,从法律层面增加高校体育资源社会参与带来的资产减值豁免规定、平衡好高校与多方主体的权利义务关系、完善学校和公共体育场馆开放互促共进机制等方面入手,方能有效助力体育强国目标实现。The independent legal status of universities and the inherent contradictions in the existing institutional design impose constraints on the active participation and practical effects of social involvement in university sports resources.Based on theoretical and practical considerations,the realistic constraints on social participation in university sports resources from the perspective of independent legal entities was explored.Facing with the contradictions between restrictions and incentives for social participation in university sports resources,conflicts between preservation and devaluation,and the trade-off between benefits and risks,it is necessary to address these issues by returning to the premise of the independent legal status of universities.This can be achieved by introducing legal provisions for asset devaluation exemptions resulting from social participation in university sports resources,balancing the relationship between the rights and obligations between universities and various stakeholders,and improving mechanisms that promote mutual advancement through the opening of school and public sports facilities.Only then can it be effectively helpful to achieve the goal of sports power.
