摘 要:用工场景中产生的劳动者人脸识别信息等生物信息具备隐私权客体属性,属于隐私权的保护对象。伴随人脸识别技术等生物技术完成从身份识别到识别分析的技术跨越,加之人脸识别技术规制的立法缺陷与劳动规范关于隐私权保护的立法缺失,劳动者隐私权保护面临困境。核心原因是人脸识别技术加剧用人单位管理权与劳动者隐私权的冲突,调和此矛盾可以基于合理隐私期待论与场景导向理念的动态因素论,对现实矛盾提出法律原则与理论适用。Biological information such as face recognition information of workers generated in labor scenarios has the attribute of object of privacy and belongs to the object of privacy protection.Accompanied by face recognition technology and other biotechnology to complete the technological leap from identification to identification analysis,coupled with the legislative defects in the regulation of face recognition technology and labor norms on the protection of privacy and other factors,the protection of the right to privacy of the workers are facing protection dilemmas,the core reason for this is that face recognition technology exacerbates the conflict between the management right of the employing unit and the right to privacy of the workers,and this contradiction is reconciled for the reason based on the concept of reasonable privacy and expectation theory and scene-oriented concept of dynamic factor theory to propose legal principles and theoretical application of the real conflict.The Dynamic Factor Theory of Expectation Theory and Scenario-Oriented Concept Proposes Legal Principles and Theoretical Applications to Realistic Conflicts.
