摘　　要：农业保险法在总体上是政策保险法,属于经济法范畴,并具有商法重要特征。农业保险法基本原则的遴选标准包括反映农业保险法所调整社会关系的本质、蕴含农业保险法根本价值、体现农业保险法基本内容、统辖农业保险法具体规则与凝聚农业保险法国际共识。农业保险法基本原则体系的内容包括社会效益至上原则、政府宏观调控与市场调节相结合原则、农业大灾风险重点防控原则、协同推进原则。以社会效益至上原则为目的性原则,以其他原则为工具性原则,共同构成一个完整体系。体系内的每项基本原则在立法上均有其独特而具体的制度要求。The agricultural insurance law is a kind of policy-oriented insurance law on the whole,falls within the category of economic law and enjoys important characteristics of commercial law.The criteria for selecting agricultural insurance law's basic principles are as follows:reflecting the nature of social relationship governed by the agricultural insurance law,containing the fundamental value of the agricultural insurance law,embodying the basic content of the agricultural insurance law,covering the specific rules of the agricultural insurance law and enshrining international consensus on the agricultural insurance law.The system of agricultural insurance law's basic principles includes the principle of putting social benefits first,the principle of combining macroeconomic regulation by the government with adjustment of the market,the principle of emphatically preventing and controlling agricultural catastrophe risks and the principle of synergistic promotion.With the principle of putting social benefits first as the purposive one and other principles as instrumental ones,these principles form a complete system.Each basic principle in the system has its own unique and specific institutional requirements in terms of legislation.
