“一带一路”倡议下中国影视企业对外版权贸易的困境及其应对

摘　　要：影视企业对外版权贸易是“一带一路”文化建设中的重点内容。各沿线国影视版权制度既具有“相同血脉”又存在独特性差异,未来将朝着国际化、完善化、安全化的方向发展。当前我国影视企业在对外版权贸易的过程中面临着国际发展环境变幻莫测、国际国内版权规则有待优化、风险防范体系急需更新三大难题。要打破对外发展瓶颈,促进文化产业互联互通,我国影视企业需以共建“一带一路”新的十年为契机,全面优化升级“一带一路”平台下的版权贸易方案,坚持“一个原则,两大突破,三重路径”的对外发展战略:以“政策沟通、设施联通、贸易畅通、资金融通、民心相通”为方向指引,将“五通”之精髓吸纳转化为合规体系的重要组成部分,结合各沿线国影视版权制度发展趋势,坚持“规则驱动”这一核心原则;把握版权贸易内容及版权贸易技术两大突破方向;遵循事前、事中、事后三重风险防范路径。Foreign copyright trade of film and television enterprises is the key content in the cultural construction of the Belt and Road.The film and television copyright systems of various countries along the route share the same bloodline but have unique differences.In the future,they will develop towards a direction of internationalization,perfection,and security.At present,Chinese film and television enterprises face three major challenges in the process of copyright cooperation and trade with foreign countries,the unpredictable international development environment,the need to optimize international and domestic copyright rules,and the urgent need to update the risk prevention system,To break the bottleneck of external development and promote the connectivity of cultural industries,China's film and television enterprises need to take the opportunity of cooperation under the Belt and Road Initiative new decade to comprehensively optimize and upgrade the copyright trade plan under the Belt and Road platform,and adhere to the foreign development strategy of"one principle,two breakthroughs,and three paths":with the direction of"policy communication,facility connectivity,unimpeded trade,financial integration,and people-to-people bonds",the essence of the"five links"will be absorbed and transformed into an important part of the compliance system.Combined with the development trend of the film and television copyright system of countries along the Belt and Road,adhere to the core principle of"rule-driven";grasp the two major breakthrough directions of copyright trade content and copyright trade technology;follow the three-phase risk prevention pathway of before,during,and after.
