摘　　要：“春秋决狱”产生并盛行于汉代,目前,学术界对于“春秋决狱”在汉代法律制度中的作用存在争议,鉴于这些不同观点之间的明显分歧,对于澄清“春秋决狱”对汉代法律体系的实际影响显得尤为重要。这不仅有助于我们更好地理解中国传统法律文化,也能为当前中国的法治建设提供一定的启示。因此,本文将在详细剖析“春秋决狱”的概念、起源背景、实施原因以及内涵的法律原则的基础上,总结评述“春秋决狱”对汉代法律制度的利弊影响,分析这一宏伟司法实践对于我国现代法治建设产生的积极启示和借鉴意义是非常重要的。深入挖掘春秋决狱对汉代法律体系的深远影响,探讨其对后世法律制度的塑造所带来的重要启示以及从中可以吸取的借鉴教训,都是我们需要认真思考和探讨的问题。“Spring and Autumn Prison”emerged and prevailed in the Han Dynasty.At present,the academic community is controversial about the role of“Spring and Autumn Prison”in the legal system of the Han Dynasty.In view of the obvious differences between these different views,it is particularly important to clarify the actual impact of“Spring and Autumn Prison”on the legal system of the Han Dynasty.This not only helps us better understand China’s traditional legal culture,but also provides some inspiration for the current construct of the rule of law in China.Therefore,on the basis of a detailed analysis of the concept,origin,background,reasons for implementation and connotation of the legal principles of“Spring and Autumn Prison”,this article will summarize and comment on the advantages and disadvantages of“Spring and Autumn Prison”on the advantages and disadvantages of the legal system of the Han Dynasty,and analyze the positive enlightenment and reference significance of this magnificent judicial practice for the construction of modern rule of law in China.Very important.In-depth exploration of the far-reaching impact of the Spring and Autumn Prison on the legal system of the Han Dynasty,the important enlightenment it brings to the shaping of the legal system of later generations and the lessons that can be learned from it are all issues that we need to seriously consider and discuss.
