社会主义核心价值观融入行政裁判文书的实践检视与优化进路--基于中国裁判文书网352份裁判文书的分析

摘　　要：社会主义核心价值观是我国社会主流价值的集中体现,深刻体现了社会主义的精髓与灵魂,将其融入行政裁判文书之中,不仅是社会进步与法治建设的必然趋势,更是强化社会共识、提升社会凝聚力的有效途径。本文基于对中国裁判文书网上352份行政裁判文书的细致剖析,发现尽管核心价值观在行政裁判中已有所体现,但其引用与融合仍面临诸多挑战,如融入范围相对局限、说理过程趋于泛化、应用方式缺乏统一标准等问题。针对这些不足,本文旨在提出一系列切实可行的优化策略与发展路径,以期促进社会主义核心价值观在行政裁判中的深度融入与有效发挥,进一步巩固法治基石,增强社会的和谐与稳定。Socialist core values are the centralized embodiment of the mainstream values of China’s society,profoundly embodying the essence and soul of socialism,and their integration into administrative adjudication documents is not only an inevitable trend of social progress and the construction of the rule of law,but also an effective way to strengthen social consensus and enhance social cohesion.Based on the detailed analysis of 352 administrative judgments on the China Judgment Website,this paper finds that although the core values have been reflected in the administrative judgments,their citation and integration still face many challenges,such as the relative limitation of the scope of integration,the generalization of the reasoning process,and the lack of uniform standards for the way of application,and so on.In view of these shortcomings,this paper aims to put forward a series of practical optimization strategies and development paths,with a view to promoting the in-depth integration of socialist core values in administrative adjudication and their effective play,further consolidating the cornerstone of the rule of law,and enhancing the harmony and stability of society.
