新业态从业人员失业保障问题研究

摘　　要：随着时代的发展,互联网技术不断进步、大众消费需求持续升级,催生出了一种区别于传统的、利用互联网实现劳动力供求大规模匹配的新型就业形态,简称“新业态”。近年来新业态从业人员数量逐年攀升,但与此同时,新业态其本身所具有的典型特点——去雇主化、平台化,造成了相关从业者劳动关系不明确、社会保障缴费义务不明晰、社会保障难覆盖等问题。本研究以社会保障项目之一的失业保险为主要研究对象,研究发现新业态从业人员参加失业保险的难点以及现行失业保险的局限性,同时提出了三种可能的解决路径。With the development of the times,the constant advancement of Internet technology and the con-tinuous upgrading of public consumption demand have given rise to a new type of employment that is different from the traditional one,using the Internet to realize large-scale matching of labour sup-ply and demand,referred to as the“new industry”.In recent years,the number of employees in the new industry has been rising year by year,but at the same time,the typical characteristics of the new industry itself—de-employerization and platformization—have caused problems such as un-clear labor relations,unclear social security contribution obligations,and difficulties in social se-curity coverage for the relevant employees.This study takes unemployment insurance,one of the social security programs,as the main research object,and finds out the difficulties of the new indus-try employees to participate in unemployment insurance and the limitations of the current unem-ployment insurance and puts forward three possible solutions.
