摘 要:双轨惩戒制度在激活公职人员任免机关、单位主体责任,规范监察机关监督责任方面发挥着重要作用。但存在任免机关、单位对违法公职人员实施惩戒的依据分散,监察机关的政务处分和任免机关、单位处分在具体适用上尚待进一步明确等问题,影响到公职人员双轨惩戒制度的实践运行。为此,我国可从优化任免机关、单位惩戒法律规范,明确监察机关和任免机关、单位惩戒管辖权冲突适用规则等方面完善公职人员双轨惩戒制度。The dual-track disciplinary system plays a significant role in activating the primary responsibility of appointing and removing authorities and units of public officials,as well as standardizing the supervisory responsibilities of supervisory organs.However,issues such as the fragmented basis for appointing and removing authorities and units to impose disciplinary measures on violating public officials,and the need for further clarification of the specific application of administrative sanctions by supervisory organs and disciplinary measures by appointing and removing authorities and units,have hindered the practical implementation of the dual-track disciplinary system for public officials.To address these issues,China can improve the dual-track disciplinary system for public officials by optimizing the legal norms for disciplinary actions by appointing and removing authorities and units,and clarifying the applicable rules for resolving conflicts of jurisdiction between supervisory organs and appointing and removing authorities and units.
