摘 要:本案是一起对职业健康检查违规违法行为进行查处的案例。执法人员在监督检查过程中,对多个违法行为的合理性进行了细致、深入的思考和论证,最后根据每个行为的具体情况分别作出了行政处罚或者不予认定的决定。本案对合理性原则的理解、适用及思辨过程,对于一线监督执法具有非常大的借鉴意义。从案情介绍、案例分析和思考建议等三个方面进行深入剖析,帮助基层执法人员进一步理解和掌握行政合理性原则,提升执法办案能力水平。This paper introduced a case of investigating and dealing with violations of occupational health inspection.During the supervision and inspection process,law enforcement personnel conducted detailed and in-depth thinking and demonstration on the rationality of multiple illegal behaviors.According to the specific situation of each behavior,finally administrative penalties or non recognition decision were made.It is necessary to introduce the application and speculation process of the principle of reasonableness in this case which could provide great reference significance for the front-line supervision and law enforcement.The authors conduct an in-depth analysis from three aspects including case introduction,case analysis and suggestions for the purpose of helping law enforcement personnel to further understand the principle of administrative rationality and improve their ability to handle cases.
