摘　　要：我国档案事业处于深化转型关键期,应完善《档案法》和《个人信息保护法》相配套的法律实施机制以促进档案工作高质量发展。基于2004年6月至2023年6月法院审结的10601份裁判文书进行全样本分析,分类梳理档案工作中个人信息保护风险。为全面提升个人信息保护力度,在清晰划定档案工作中个人信息保护边界的基础上,提出档案管理过程中应推动完整性审查与监管科技运用;档案公开过程中应健全影响评估、匿名化处理及司法救济制度;档案利用过程中应实施全流程监管并提升刑法保护力度。最后,从档案开放审核等多维度提出《档案法实施条例》的调整建议,以有效提升依法治档能力。China's archival business is in a critical period of deepening transformation,and the legal implementation mechanism matching the Archives Law and the Personal Information Protection Law should be improved to promote the high-quality development of archival work.Based on the full sample analysis of 10,601 judgments concluded by the courts from June 2004 to June 2023,the risks of personal information protection in archives are categorized and sorted out.In order to comprehensively enhance the protection of personal information,on the basis of a clear delineation of the boundaries of personal information protection in archival work,it is proposed that integrity review and the use of supervisory science and technology should be promoted in the process of archives management;that a sound system of impact assessment,anonymization and judicial remedies should be established in the process of archives disclosure;and that the whole process of archives utilization should be supervised and the protection of criminal law should be enhanced.Finally,it proposes adjustments to the Regulations for the Implementation of the Archives Law from the multi-dimensional viewpoint of archives openness audit,so as to effectively enhance the ability to rule the archives in accordance with the law.
